EB-2 National Interest Waiver Visa
The EB-2 visa is typically for professionals with advanced degrees (Masters, Doctorate, PhD), or a Bachelor degrees plus five years professional experience, or individuals with exceptional ability in their field. However, the standard EB2 process requires a job offer and a lengthy (PERM) Permanent Labor Certification process, proving that no American worker is available for the position.
The EB -2 NIW is a subcategory of the EB-2 visa that “waives” the job offer and labor certification requirement if the applicant can demonstrate that their work is in the national interest of the United States. This can be shown by proving that your work will have a significant impact on the U.S. economy, health, education, culture, or welfare.
NIW stands for “National Interest Waiver”. It allows you to self-petition (file without a sponsoring employer). The “Waiver” means that the U.S. government is making an exception in certain cases that are in the national interest, and therefore waives the lengthy (PERM) Permanent Labor Certification process.
