EB-5 Immigrant Investor Program
The US Government created the EB-5 (employment-based, 5th preference) Immigrant Investor Program to help encourage foreign nationals to invest in American businesses.
The program provides a pathway to lawful United States permanent residence (“green card”) for foreigners who invest at least USD $1.05 million in a new commercial enterprise that creates 10 full-time jobs. If the business is located in a “Targeted Employment Area” (TEA), defined as a locality with high unemployment or a rural region, the minimum investment requirement is reduced to USD $800,000.
The EB-5 program is currently the only visa program in the United States that allows foreign investors to directly obtain permanent residency.
The investor and his or her dependents; i.e. spouse and any unmarried children under 21 years of age, can obtain conditional permanent residence at the same time.
